Our services are performed in accordance with industry standards and the applicable laws of the State of Florida and Clay County. The Site is for informational purposes, to showcase our portfolio, and to provide a platform for you to request a project quote.

Client Responsibilities

  • Accuracy of Information: When you request a quote or contact us through the Site, you agree to provide accurate and complete information about your project, including its condition, size, and any specific requirements.

  • Property Access: You agree to provide us with safe, clear, and timely access to your property and the work area as scheduled.

  • Preparation: You are responsible for clearing all items from cabinets and removing all personal property, valuables, fragile items, and other objects from the work area before our team arrives. We will not be held responsible for any damage to items that are not removed from the designated work area.

  • Pre-Existing Conditions: We are not responsible for damages caused by pre-existing conditions of the cabinets or property, including but not limited to warped wood, delaminating laminate, damage from heat or water, or structural issues. Any repairs to such conditions are outside the scope of our painting services unless explicitly agreed upon in a signed contract.

Quotes, Contracts, and Payments

  • Quotes: All quotes provided by us are estimates based on the information provided and are valid for a period of [e.g., 30 days]. A quote is not a contract.

  • Contract: A formal, written contract will be provided for all work to be performed. This contract will detail the full scope of work, including the specific services, materials to be used, and the total project cost. Your project will not commence until this contract is signed by both parties.

  • Payments: Payment terms, including deposit requirements and final payment due dates, will be clearly outlined in your project contract. Failure to make payments as scheduled may result in project delays or termination of the agreement.

  • Changes in Scope: Any changes or additions to the work described in the contract must be agreed upon by both parties in a written addendum to the contract. The final project cost and timeline may be adjusted accordingly.

Warranties and Disclaimers

  • Workmanship Warranty: We warrant our workmanship for a period of one year from the date of project completion against peeling, blistering, or cracking due to improper application. This warranty does not cover issues caused by:

    • Normal wear and tear.

    • Physical damage, scratches, or abrasions.

    • Damage from harsh chemicals or abrasive cleaners.

    • Failure of the original substrate or underlying surface.

    • DAMAGE CAUSED BY OTHER CONTRACTORS.

  • Limitation of Liability: Our liability for any claim arising from our services is strictly limited to the total amount paid for the project as specified in the contract. We shall not be liable for any indirect, incidental, special, or consequential damages.

Use of Project Photos

You agree that we may take before, during, and after photos of the work area for our portfolio, marketing materials, and social media. These photos will be used to showcase the quality of our services. We will not share any identifying information about your property without your explicit consent.

Intellectual Property

The Site and its original content, features, and functionality are and will remain the exclusive property of VIVA LA BRUSH and its licensors. The content is protected by copyright, trademark, and other laws of the United States and foreign countries. You may not use any content from the Site without our express written permission.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding related to the Site or these Terms shall be brought exclusively in the courts of Clay County, Florida.
